L-1 Visa Requirements
Employee Requirements
- Worked for foreign affiliate for at least 1 year in the past 3 years
- L-1A: Employed in managerial or executive capacity
- L-1B: Possess specialized knowledge of company products/services
Company Requirements
- Qualifying relationship (parent, subsidiary, affiliate, or branch)
- US company must be doing business (goods or services)
- Foreign company must remain operational during L-1 status
New Office L-1 (Startup)
For new US offices: Initial petition approved for only 1 year. Must demonstrate sufficient physical premises and ability to support executive/managerial position within 1 year. Extension requires proof of business growth.
L-2 Dependent Benefits
L-2 spouses can apply for Employment Authorization Document (EAD) allowing them to work for any US employer without restrictions.
